These terms apply when you install a Quiet Penguin app from the Shopify App Store. Installing the app means you agree to them. They're short on purpose.

Who we are

Quiet Penguin is Stephen Bedford, a sole trader based in Ireland, trading as Quiet Penguin. Contact: support@quietpenguin.com.

The service

Our apps watch your store and tell you when something needs attention. Missing Orders checks your paid Shopify orders against Starshipit and emails you when one hasn't arrived. It reads from Shopify and Starshipit and never changes anything in either.

It's a safety net, not a guarantee. The app is designed to stay silent when it can't be sure, so it won't catch every possible problem, and it depends on Shopify and Starshipit being available. You remain responsible for fulfilling your orders. We aren't liable for orders it doesn't flag, or for losses from delays in fulfilment.

Billing

Plans are billed by Shopify, through your Shopify invoice, at the price shown on the App Store listing, after any free trial. You can cancel at any time by uninstalling the app; Shopify handles any refunds under its own terms.

Your data, and how we process it for you

For your store's order data, you are the controller and we are your processor. We process it only to provide the app, on your instructions, which are given by installing and configuring it. Specifically, we:

• process only the data described in our privacy policy, and no customer names, emails, phone numbers or addresses;
• never sell it, use it for advertising, or combine it with other data;
• use only the sub-processors listed in the privacy policy, under their own data protection terms, and update that list before adding one;
• keep it confidential and protect it with encryption in transit and at rest;
• help you answer requests from your customers about their data, and delete a customer's records when Shopify tells us they've asked;
• delete your Starshipit keys as soon as you uninstall, and everything else we hold for your store when Shopify asks us to, 48 hours after you uninstall;
• tell you without undue delay if we become aware of a breach affecting your data.

Using the apps fairly

Don't use the apps for anything unlawful, or try to access data that isn't yours. We may suspend access to protect the service or other merchants, and will tell you why.

Changes and law

If we change these terms, we'll update the date above and email you first if the change affects you. These terms are governed by the laws of Ireland. Nothing here limits rights you have that can't be limited by law.
